Alternative Dispute Resolution Alternative Dispute Resolution (ADR) is a broad label that encompasses, at a minimum, mediation and arbitration. Mediation uses a neutral, independent facilitator who assists the parties in coming to an agreement. The agreement is reached not by the order of a third party (like a judge) but by consensus of the parties. Arbitration is similar to trial, but is held before a neutral, independent third party who is chosen by the parties. While the ultimate decision is rendered by someone other than the parties, control over who that person is and the rules for the arbitration are usually agreed to by the parties.
